Tax Tip #31, Georgia Property Tax Freeport Exemption

In a recent Georgia Court of Appeals case, Walmart was successful in arguing that self-checkout parts held in a warehouse in Georgia qualified for the Category 3 Freeport Exemption from business personal property tax. Walmart’s argument centered on 2 points:

The parts were considered inventory of finished goods, and
The parts would be shipped to an out-of-state Walmart store within 90 days.
This may expand the definition of Category 3 to include some equipment held in Georgia for shipment out of State.
